Why is CBD Sometimes Illegal In Different States?

  4. Additionally, the bill resulted in the individual states and the FDA receiving the approval to come to their conclusions regarding hemp and hemp-derived products. The FDA approved the use of hemp-derived CBD and a select range of hemp products to be used as food additives (like hemp seed protein and hemp seed oil), while individual states have granted full freedom hemp use for human consumption. In other words, 2018 created a shift only to the degree that hemp was no longer as illegal or as controlled as marijuana. But how legal it is and what controls apply depends on individual states. With over 50 states researching hemp, debating hemp, and deciding on how to proceed with the legislation regarding hemp, it is obvious why there is no single unanimous answer as to whether CBD is legal or illegal.
