Because the psychoactive substance is found in a higher concentration in marijuana, it is strictly regulated and controlled on a federal level. Such controls do not apply to hemp cultivated to contain 0.3% or less THC by dry weight. This limit was set in the Farm Bill of 2018.

However, if the THC levels exceed 0.3%, the same controls that govern marijuana production and distribution would apply. These views apply not just to the hemp and marijuana crops, but also to their derivatives. Because CBD can come from marijuana and hemp, it can have a federally legal or illegal status depending on its origin.
  4. Moreover, the FDA and 50 states were all approved to determine their individual conclusions regarding hemp products. Since CBD is a hemp product, certain states decided it was okay to use while CBD that came from marijuana remained a controlled substance. Other states continued to view hemp-derived CBD the way they see marijuana-derived CBD despite the federal government allowing the two to be categorized separately. This has caused inconsistencies in the legal status of CBD, depending on the state one is in.
