Why is CBD Sometimes Illegal In Different States?

Multiple factors are responsible for the current legal status of CBD. Depending on the state, CBD could be completely legal or highly controlled. So how did it all start?

  1. Initially, the FDA approved Cannabidiol as a controlled substance. But because of how drug patent laws work, it was approved for a limited range of uses. 
  2. The reason it was approved as a controlled substance had to do with CBD’s THC content. THC, a psychoactive substance, can be abused to get high. 
  3. Since CBD was controlled, so were its sources. That’s where the different types of CBD become relevant. With the 2018 United States Farm Bill, CBD from industrial hemp (with less than 0.3% THC and low abuse potential) was classified separately from marijuana-derived CBD.
  4. It not only gave CBD sourced from hemp a federal ‘okay, but’ it also gave the individual states the freedom to decide their laws regarding hemp and hemp-derived products. The FDA has not approved CBD as an additive to food while individual states have. That’s why the status of CBD is slightly confusing. But it is merely a difference that comes from 50 states coming to their separate conclusions.
