In early 2018, a bill passed called the Farm Bill.  This bill regulates the production and distribution of hemp.  In particular, the law states that any product derived from hemp is excellent as long as it contains no more than 0.3% THC by weight.  So CBD made from hemp with less than 0.3% is perfectly legal for all intents and purposes.  Although it may still need permits for regulations if intended for ingestion, just like many foods, it would even need to pass FDA inspection.

If we look only two years before the Farm Bill, Alabama had already passed legislation allowing CBD use for extreme medical conditions such as epilepsy.  Thanks to a study at the University of Alabama at Birmingham that showed that CBD helps epilepsy patients, the bill wasn’t hard to get through the red tape. 

It was called Leni’s Law.  But, we’ll dive more into the history later.  Let’s have a look at some of the age requirements also involved with hemp and marijuana-derived products.

What Is CBD?

Cannabidiol/CBD is a cannabinoid found in hemp and marijuana plants. It has various uses and is added to products like skin creams, smokable liquids, and essential oils. The amount, and the kind, of CBD you get depends on whether it comes from marijuana or hemp.

How is Hemp Different From Marijuana?

Hemp and marijuana look different. Marijuana grows like a bush and has many more flowers and leaves than hemp, which grows in lean bamboo-like stalks.

More importantly, the groups of strains vary in the levels of THC they contain. THC is psychoactive and can be abused to get high. Marijuana has an abundance of THC and can give one ‘a high,’ whereas industrial hemp is explicitly bred to contain no more than 0.3% THC. Because of this difference, marijuana is a highly controlled substance, on a federal level, whereas hemp is considered an industrial crop.

Does Hemp or Marijuana Have More CBD Oil?

Marijuana has a comparatively larger CBD output of the two because of several factors. First of all, there is more CBD in marijuana leaves than is in hemp leaves. On top of that, marijuana has more leaves, buds, and resin than hemp. Therefore, hemp’s yield of CBD does not even come close to that of marijuana.

But that will not be the case for long. While traditional strains of industrial hemp have a low CBD output, certain strains are being bred specifically to produce more CBD while retaining a 0.3% THC content. That would increase the amount of federally legal CBD coming out of hemp farms.

Why is CBD Sometimes Illegal In Different States?

Multiple factors lead to CBD having different legal statuses in other states.

  1. The legalization of CBD starts with limited approval from the FDA in response to a drug approval request. Because of how drug patents operate, a limited range of uses was made legal but under the condition that the drug is obtainable by prescription only.
  2. The reason behind this strict conditional-approval had little to do with CBD and more to do with the THC contained in CBD. THC is a psychoactive compound that can get one high. It is present in CBD regardless of whether the CBD comes from marijuana or hemp. Therefore, marijuana and hemp were strictly controlled, on a federal level, and banned for general use.
  3. However, it wasn’t fair because not all CBD contains the same levels of THC. For instance, industrial hemp has less than 0.3% THC, making it virtually impossible to get high off. With the 2018 United States Farm bill taken into account, industrial hemp became federally legal. Of course, this was contingent on there being no more than 0.3% THC in industrial hemp.
  4. Moreover, each state was approved to conclude regarding hemp and its derivatives. Some states moved to legalize it, while others continue to research it to this day. That is why CBD’s legal status varies across the United States.

Is CBD Legal In Alabama?

CBD oil first became legal in Alabama in 2014 with the Carly’s Law bill.  This bill was passed on April 1, 2014, and permitted the University of Alabama at Birmingham to use CBD to help patients with severe epilepsy.

The first bill, Carly’s Law, dealing with CBD, was very restrictive.  It treated CBD like some form of heavy narcotic, with only the prescribed person being able to possess it.

It wasn’t until 2016 that things started to loosen up a bit with Leny’s Law’s passing.  This new law enabled the parents or legal guardians of minors with a severe medical condition to possess CBD on behalf of their child.

A couple more years and 2018 brought about the Farm Bill, as previously mentioned.  It allowed for the removal of low THC hemp from the Controlled Substances Act.  It created an open door for many cultivators to seek to license to grow hemp, far more comfortable to achieve a license.  The level considered to be low THC is 0.3% by weight.
